Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Social Media Automation (the “Service”), provided through app.socialmediaautomation.xyz. By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

The Service monitors content sources you choose, uses artificial intelligence to draft original social media posts, lets you review and edit them, and publishes approved posts to the third-party social media accounts you connect and authorize. Features may change, be added, or be removed over time.

2. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
You are responsible for safeguarding your login credentials and for all activity under your account.
You must provide accurate information and keep it up to date.

3. Connected accounts & authorization

To publish on your behalf, you connect third-party platform accounts (such as Facebook, Instagram, Threads, or Bluesky). You represent that you own or are authorized to manage each connected account, and you authorize the Service to create, schedule, and publish content to them on your instruction. You can disconnect any account at any time, which revokes that authorization going forward.

4. Your responsibilities & acceptable use

You agree not to use the Service to:

Publish content that is unlawful, infringing, defamatory, hateful, harassing, deceptive, or that violates anyone’s rights.
Post spam, run coordinated inauthentic behavior, or otherwise violate the rules, terms, or policies of any connected platform.
Misrepresent the source of content, impersonate any person or entity, or use a real person’s likeness or voice without rights.
Infringe intellectual property or republish third-party content beyond what is permitted by law (e.g., fair use of attributed commentary).
Attempt to breach, overload, reverse-engineer, or disrupt the Service or its providers.

You are solely responsible for the content you approve and publish, including ensuring you have the rights to any source material, images, or media used, and for complying with each platform’s rules.

5. AI-generated content

Posts are drafted by automated AI systems and may contain errors, inaccuracies, or content that does not reflect your views. You are responsible for reviewing content before it is published. Where you enable auto-approval or auto-publishing, you accept responsibility for content published without manual review. The Service does not guarantee the accuracy, originality, or non-infringement of AI-generated output.

6. Third-party platforms & compliance

The Service interoperates with third-party platforms and APIs (including Meta’s Facebook, Instagram, and Threads). Your use of those platforms through the Service is also subject to their respective terms and policies, including the Meta Platform Terms. We are not responsible for changes, outages, rate limits, rejections, or actions taken by those platforms, including the suspension or removal of your posts or accounts.

7. Costs of third-party APIs

Some connected platforms or AI providers may charge usage fees (for example, paid posting APIs or AI token usage). You are responsible for understanding and, where applicable, bearing such costs associated with your use.

8. Intellectual property

The Service, including its software, design, and branding, is owned by us and protected by applicable laws. You retain ownership of the content and configurations you create. You grant us a limited license to process and transmit your content solely to operate the Service (for example, sending source text to the AI provider and delivering approved posts to your connected platforms).

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any post will be successfully published or perform in any particular way.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or reputation, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD $50.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or of any third-party rights or platform policies.

12. Termination

You may stop using the Service and delete your data at any time (see the Data Deletion section of our Privacy Policy). We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others, the platforms, or us.

13. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be reflected by updating the “Last updated” date above. Your continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles. Any disputes will be subject to the courts located in Bangladesh, unless otherwise required by applicable law.
